Tulsa's Best Civil Litigation Attorneys

  • Reads the contract, the correspondence, and the documents before quoting a fee — if a claim isn't worth pursuing, you'll hear it in the first conversation, not after a retainer clears.

  • Preserves the record early — litigation holds, document collection, and witness statements go out while people still remember and files still exist.

  • Writes a theory of the case before the first deposition, then builds leverage through discovery so most matters resolve on better terms — but tries the ones that have to be tried.

Oklahoma Deadlines Do Not Wait

Under 12 O.S. § 95, the time to file a civil claim in Oklahoma is limited, and once it passes the claim is gone regardless of how strong it was:

  • Written contract — five years.
  • Oral contract — three years.
  • Trespass, injury to personal property, and most other tort claims not arising on contract — two years.
  • Fraud — two years, and the claim is generally not deemed to accrue until the fraud is discovered.
  • Libel, slander, assault, battery, malicious prosecution, and false imprisonment — one year.

These are general periods. The date a claim actually accrues is frequently disputed, and contracts, statutes, and government-entity rules can shorten them substantially. If you are anywhere near a deadline, call (918) 933-0123 today rather than waiting to gather documents — we can file to protect the claim and assemble the file afterward.

Civil Litigation FAQ

How long does a civil lawsuit take in Oklahoma?

A straightforward contract case often resolves in nine to eighteen months. Complex business or construction matters commonly run two years or more, and an appeal adds a year to eighteen months on top of that. The honest answer depends on the county, the judge's docket, the number of parties, and how much discovery the case requires.

What does it cost to bring a civil case?

It depends on the structure. Some matters are handled hourly, some on a flat fee for a defined phase, and some on contingency where the claim supports it. Oklahoma follows the American rule — each side generally pays its own attorney fees unless a statute or a clause in your contract shifts them. Whether your contract has a fee-shifting provision often changes the entire calculus.

Do I have to go to trial?

Probably not. The large majority of civil cases resolve before trial. But you should hire a lawyer who is prepared to try it, because the resolution you get is a direct function of what the other side believes will happen if you do not settle.

The contract says we have to arbitrate. Does that end it?

Not necessarily, and not always in the way people assume. Arbitration clauses vary widely in scope and enforceability, and some claims fall outside them. Even where arbitration applies, it is still a contested proceeding requiring evidence, witnesses, and advocacy.

I think I might be past the deadline. Is it worth calling?

Yes. When a claim accrues is a legal question, not an obvious one — discovery rules, tolling, continuing violations, and contract terms all affect it. Do not decide on your own that you are out of time.
